That tap was not incidental, the guy has his bat fully extended.
The car had slowed, almost stopped.
One would think, if you were going to do such a thing, you
would barreling down the downhill street, and really going for it.
Not if you were planning to drive away afterwards. And again, just assumptions. I'm not going to try to justify these actions, that's what courts and trials are for.

You recall I race cars as a hobby, right? I could drift my Dad's '75 Buick (454 Olds w/Rochester 4 barrel) through parking lots at 16. I crashed 2 Camaros before I was 19.
And mental conditions aren't an indicator of physical competence, just like physical conditions aren't an indication of mental competence.
