My claim was 1st degree murder could turn out to be over-charging.

There didn't appear to be evidence or planning or malice. I'm still not sure there was. Apparently at the trial reports turned up of something like he picked up hitchhikers who claimed he told them where he was going and what he meant to do there. Cause troubel. Something like that anyway.

It's hard to know what actually happened in the actual trial though because media was banned so we weren't getting 'as it happens' reports.

Yeah I remember the whole "heart attack" defense thing. That was quite honestly one of the most pathetic attempts at defending outright murder I've ever seen.

The heart attack was claimed by the mother in a mainstream publication - NBC or something like that.

So if she said that - and she did - it was worth reporting that she said it. Under pressure though the authorities later gave out the news that it wasn't a heart attack it was heart failure which we were told were 2 different things.

I still think a better lawyer could have made a better case against malice and premeditation.

And I think the public should have been allowed to see how the case was tried as it was tried. But we weren't and because we weren't I'm not sure that a conviction necessarily proved there was malice and aforethought.

That doesn't mean Fields wasn't a whacked out radical white nationalist who deserved severe punishment for the carnage he created. It means I'm still not convinced 1st degree murder wasn't overcharging.
