You got it. And in it lies the dangers others may attempt to negate or intrude on legal treaties with other Bands, using it a precedent.
The individuals of that Band stand to benefit equally with everyone else, but there is no legal standing for the Band itself to gain from a mine in another Bands treaty area.
Vancouver can't claim the right to tax gravel from a pit in Chilliwack, Victoria can't claim a royalty from Alberta oil on the basis it says it should be able to.
Certain hard-core people seem to benefit by taking a very "PQ" approach:
- never say exactly what you want because you might get it. Reject every offer as not good enough.
- boycott every opportunity to meet so you can claim you've never been consulted.
Hope that even if it turns out a massive FAIL, everyone is so disgusted with the politics they don't show up and vote you out.
