Yes. Your sarcasm is right on the mark. It's called mitigating circumstances. Just like we should punish people more severely (aggravating circumstances) for things like extreme cruelty and habitual offending. And it's already an accepted part of the system. Didn't work, in this case, because of minimum sentencing though.
